About a year ago, I wrote about a class action lawsuit that involved purchases of gas engine lawn mowers dating back to 1994. Claims had to be filed by August 31st, 2010. The original post can be found HERE.
Well, today I received my settlement check. Drum roll please....

But that amount times the number of customers that were short changed adds up. Companies that conduct practices that are deserving of class action status reap greatly from their actions, and the class action vehicle is usually the only thing to attempt balance.
I agree with George that the small amounts add up. $10.19 X the number of mowers claimed can add up real fast. On another note, Re: The Northern Law Blog posted titled, "BAR / BRI Class Action Settlement" (http://www.northernlawblog.com/2011/05/bar-bri-class-action-settlement.html), earlier this month I got notice that there's ANOTHER Bar/Bri Class Action. My mother also got her large check for $21 for her Kohler engine on her Craftsman GT5000 lawn tractor along with an extended warranty paper. Her mower has not been usable in over 3 years due to excessive oil consumption. I took it to a authorized shop and the manager said he knew nothing of this extended warranty and stated he called kohler and said they knew nothing of it and my mother who is now 75 on a fixed income would have to pay $600.00 to have the engine rebuilt and try to get reimbursed by kohler. I then called the number on kohlers website whih connected me with Gardner corp who handles warranty repairs. They said they were aware of this warranty extension and contacted the dealer and requested pictures of the lawn mower. It has ben over a week now so i called the servicer today and was told that warranty was denied because of lack of maintenance because the tractor was dirty and the air filter was dirty. I knew the tractor was dirty but the tractor was parked under my mothers cover patio for over 3 years. Why would you service a lawn mower that you could not use. My mother has about 2 acres of lawn to cut. I gave her a spare 38" cub to use since hers was consuming so much oil. I serviced her mower at least annualy , oil, filters, blades. If anyone can help in this matter it would be appreciated. It appears to me that this is another case of the lawyers reaping large rewards and the warrantty the customer gets is not worth the paper it is written on. I own 4 lawn mowers and i know the value of proper maintenance. 3 have kohlers and one has a honda and because i have maintained them properly. When i read about this GT5000 mower on various websites their are numerious complaints of excessive oil consumption with this particular Kohler CV730-0029 engine. For now i have lost my confidence with kohler and will only buy Honda or Kawasaki from now on.

No check here either. My guess is that the attorneys on both sides took off with the settlement monies. Such is usually the case. The consumer is lucky to get a 10% off coupon for a new product from the same dodgy manufacturer, while the lawyers chock up fees to buy a villa in St Lucia.
